Because criminal law intervenes directly in the freedom of individuals, it is a branch of law which has its own principles and system. The types of crimes and the way they are committed may change in relation to the development and spread of information technologies. On one hand, new types of crimes appear, on the other, new outlooks on some traditional crimes must be understood and re-evaluated. The legal system is stagnant compared to the advancement of technology, which causes difficulties in the struggle against cybercrimes, even proving abortive. In this course, crime theory will be reviewed and crimes related to information technology will be evaluated by means of case law, international covenants and practices all over the world. Furthermore, the gathering, analysis and reporting of electronic evidence will be discussed in the light of actual criminal procedure rules and technical principles of computer forensics. The criminal and civil liability system set forth in Law No. 5651 which regulates internet publishing and claims to prevent many crimes will be analyzed in great detail.

Information and communication technologies (ICT) is everywhere and for everyone. Internet has become part of individuals, companies, institutions and governments around the world. Naturally e-commerce and all the derivative applications of “e” in commercial and business life are more seriously considered in recent years. The impact of Internet and ICT on the economic, political and social environment necessitates approaching the issue from a legal perspective. E-business rules and e-commerce dynamics differ from the traditional rules. The objective of this course is to provide an understanding of e-business and e-commerce facts to enable the participants of the program to evaluate the new ways of doing business more accurately. Various kinds of interaction and transactions occur over the Internet. Web 2.0 and Web 3.0 and the potential new versions of the Web introduced the Social Media and Semantic Web. The importance of privacy issues increased with all these new applications. Understanding the basics of e-commerce rules and applications is a prerequisite to elaborate the juristic cases stemming from all these masses of transactions, interactions and sharing over the Internet. The content of the course is planned to cover the key managerial issues of e-business and e-commerce rather than the technical issues. To accomplish the above course objective, the following topics will be addressed: e-business models, Web site features, e-business strategies, opportunities in e-business, online marketing in relation to customer relationship management, interactive marketing and permission marketing. Computer Forensics is designed to acquaint students with practical and legal concepts unique to the field of computer crime and computer forensic analysis. Computer forensics is typically defined as a scientific, systematic inspection of an electronic media and its’ contents for evidence or supportive evidence of a crime. As the use of computers and the Internet has become more prevalent within our society, computer forensics has developed into a highly technical field requiring specialized expertise. This course will attempt to educate students regarding appropriate computer forensics processes, and the importance of adhering to a strict set of standards when gathering and analyzing electronic data. This course introduces students to the collection, preservation, presentation and preparation of computer-based evidence for the purposes of criminal law enforcement or civil litigation. These activities define the central role of computer forensic practitioners involved in investigating computer crime scenes and torts involving computers.

The course will examine the law, policy and governance of Internet in Turkey. The main objective of this course is to scrutinise the evolution of the legal, institutional and policy frameworks of Internet in Turkey. The course will particularly focus on the issue of fighting against unlawful and inappropriate Internet content. The increasing number of international, regional and national regulations and rules dealing with Internet gave rise to a special regime of roles, rights and obligations for the main Internet actors and stakeholders. The inefficiencies of classical regulatory frameworks in bringing solutions that meet the technical and dynamic nature of Internet, have led to emergence of a new governance model, which is specific for Internet. Another main objective of this course is comprehensively evaluating the Internet-specific governance model from the international and national (Turkish) perspectives. The lectures within this course will be carried out through in-class discussions; working groups and presentations in order to ensure active participation of the students. It is aimed to develop in-depth familiarity with a subset of the issues through intensive researches, discussions, and presentations.

This course will involve provision of information about data-based economics, big data as a component of this concept and global application examples at the outset. In that respect, the position of data in economics and business world as well as the added value created by data will be explained by means of examples from several industries. Also, the purpose and scope of data collection methods, data deduplication, data enrichment and profiling, data storage and similar CRM applications will be explained so that students may gain insight as to cloud and similar data technologies as well as several analytical CRM applications and new business models adopted by corporations. Students will be informed about information security problems which arise during data applications in addition to the technological and legal measures required to be taken to that end. Focusing on the most frequently used CRM contract types in practice, information will be provided about the important technical and legal points which should be taken into consideration while drafting those contracts. Especially, examining European General Data Protection Regulation’s provisions thoroughly, which is likely to affect business all around the world, is important for Turkish Data Protection applications. In addition, all participants will be well positioned at the end of the semester to successfully complete the IAPP CIPP/E certification exam, which has been accredited worldwide. CIPP/E certification is an indicator of a comprehensive understanding of the GDPR and its applications. This class also intends to get students familiarise with best practices in data protection law around the world.
